Judge Steven Hippler denied a motion on Tuesday from Bryan Kohberger's defense team that asked to remove the death penalty as a possible punishment.

As the murder trial for Bryan Kohberger inches closer, the judge is refusing to rule out the death penalty if he is convicted and appears unpersuaded that the massive amount of evidence in the case has hampered the defense team from doing their job.

The decision marks the 13th time the Idaho judge has ruled against the defense's attempt to remove the death penalty from the case.
